Privacy policy

How we handle your data – under the Swiss FADP and the GDPR.

Protecting your personal data matters to us. This privacy policy explains which data we process when you visit ja-kernkraft.ch, for what purpose, and which rights you have. It follows the Swiss Federal Act on Data Protection (FADP) and, for visitors from the EU/EEA and insofar as the campaign sponsor is subject to it, the General Data Protection Regulation (GDPR).

1. Controller

WePlanet DACH e.V. (see legal notice)
Bessemerstrasse 51, 1st floor, 12103 Berlin, Germany
Email: ja-kernkraft@weplanet-dach.org

Contact for data protection questions: the board, reachable at ja-kernkraft@weplanet-dach.org. The association is established in the EU, so no representative under Art. 27 GDPR is required. A representative in Switzerland (Art. 14 FADP) is not required: this website does not process personal data extensively and regularly with a high risk for persons in Switzerland, only consent-based statistics and contact enquiries.

2. Principles and legal bases

We process personal data only insofar as necessary to operate the website, communicate with you and run the campaign, following the principles of lawfulness, proportionality, purpose limitation and data security (Art. 6 ff. FADP). Where the GDPR applies, we rely on your consent (Art. 6(1)(a) GDPR, e.g. statistics cookies) or on our legitimate interest in a secure, functioning website and in the campaign's public relations (Art. 6(1)(f) GDPR).

3. Hosting and server log files

For hosting, technical provision and supporting infrastructure we use – as WePlanet DACH e.V. does for weplanet-dach.org – the following service providers: Host Europe GmbH, Hansestrasse 111, 51149 Cologne, Germany, and Webforum Löffler KG, Leopoldstrasse 20, 6020 Innsbruck, Austria (servers located in the EU). When you access the website, the web server automatically records in log files: IP address (truncated or deleted after 30 days at the latest), date and time, page requested, data volume transferred, browser type and version, operating system and the referring page. These data serve solely to ensure operation, analyse errors and defend against attacks; they are not merged with other data sources. A data processing agreement is in place with the hosting provider (Art. 9 FADP / Art. 28 GDPR).

4. Cookies and consent

On your first visit this website sets no cookies. Only when you make a choice in the cookie banner do we store your decision in the cookie jk_consent (6 months, strictly necessary, Art. 45c(b) Swiss Telecommunications Act). All other services load exclusively after your consent (Art. 45c TCA, Sec. 25 German TDDDG, Art. 6(1)(a) GDPR). You can change or withdraw your consent at any time with effect for the future: open cookie settings (also via the cookie button in the bar at the bottom of the screen).

5. Statistics: Google Analytics 4

With your consent we use Google Analytics 4 provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”) to understand how the campaign website is used (page views, time on site, approximate origin, device type). Google Analytics 4 does not store full IP addresses; evaluation is aggregated. We use Google Consent Mode v2: without consent no analytics cookies are set and no data is sent to Google. Data retention at Google is set to 14 months. No Google Analytics property is currently set up for this website; Google Analytics is not loaded. This section applies once it is activated.

Google may transfer data to the USA. Google LLC is certified under the Swiss-U.S. Data Privacy Framework (recognised by the Federal Council on 14 August 2024, in force since 15 September 2024, Annex 1 DPO) and the EU-U.S. Data Privacy Framework, which provides an adequate level of protection within the meaning of Art. 16 FADP and Art. 45 GDPR. Further information: Google privacy policy, browser add-on to opt out of Google Analytics.

6. Marketing services (only with consent)

To measure the success of campaign ads we may use the Meta pixel (Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland) and the LinkedIn Insight Tag (LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland). These services load exclusively with your consent in the “Marketing” category. Current status: not active – neither the Meta pixel nor the LinkedIn Insight Tag is loaded. Both providers are certified under the Swiss-U.S. and EU-U.S. Data Privacy Framework. Privacy information: Meta, LinkedIn.

7. External media and social media embeds (only with consent)

Campaign reels and videos may be embedded from YouTube (Google Ireland Limited; we use the privacy-enhanced mode via youtube-nocookie.com), Instagram (Meta Platforms Ireland Limited) and LinkedIn (LinkedIn Ireland Unlimited Company). Such content only loads once you consent to the “External media” category or unlock the content by clicking. Until then you see a placeholder with a link to the respective platform. When loading, the provider receives your IP address and may set cookies; if you are logged in there, it can link the visit to your account.

8. Links to our social media channels

The icons in the bar at the bottom of the screen are plain links to our profiles on Instagram, YouTube, LinkedIn, X and Facebook. When you click them you leave our website and the privacy policy of the respective platform applies. Merely displaying our website transfers no data to these providers.

9. Contact by email

If you write to ja-kernkraft@weplanet-dach.org, we process your details (name, email address, content of the message) to answer your enquiry and – if you join the supporters' alliance – to list your organisation. The data is deleted once the enquiry has been dealt with and no statutory retention obligations apply. The mailbox is operated on Microsoft 365 (Exchange Online): Microsoft Ireland Operations Ltd., One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland; a data processing agreement under Art. 28 GDPR is in place with Microsoft.

10. Newsletter (in preparation)

Once a newsletter is offered, registration will use a double opt-in procedure; your email address will be used exclusively to send campaign information and stored with the mailing provider rapidmail (rapidmail GmbH, Wentzingerstrasse 21, 79106 Freiburg, Germany). You can unsubscribe at any time via the link in every issue. This section will be completed when the newsletter is introduced.

11. Downloads, fonts and other technology

The fact-check report (PDF) is delivered directly from our server; only the log data described in section 3 is generated. Fonts are loaded locally from our server (no Google Fonts, no connection to third-party servers). The website software (WordPress with Breakdance) sets no tracking or counting cookies of its own.

12. Disclosure and transfers abroad

We disclose personal data only to the service providers named in this policy (hosting, email, and with consent Google, Meta, LinkedIn) and only insofar as necessary for the respective purpose. Providers in the EU/EEA offer a level of data protection comparable to Switzerland; for transfers to the USA we rely on the recipient's certification under the Swiss-U.S. or EU-U.S. Data Privacy Framework or on the EU Commission's standard contractual clauses with the Swiss amendments recognised by the FDPIC.

13. Retention

We keep personal data only as long as necessary for the respective purpose: server log data for a maximum of 30 days, correspondence until the enquiry is closed (or in line with statutory retention periods of generally ten years for business-relevant records), statistics data for 14 months, cookie choice for 6 months.

14. Data security

The website is delivered exclusively over an encrypted connection (HTTPS/TLS). Access to the editorial system is password-protected and restricted to the campaign editors; regular backups are made.

15. Your rights

You have the right to information about the data processed about you (Art. 25 FADP / Art. 15 GDPR), to data release or portability (Art. 28 FADP / Art. 20 GDPR), to rectification, erasure or restriction of processing (Art. 32 FADP / Art. 16–18 GDPR) and to object to processing (Art. 30 FADP / Art. 21 GDPR). You may withdraw any consent given at any time. Please send requests to ja-kernkraft@weplanet-dach.org; we may ask for proof of identity.

The supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch. Visitors from the EU/EEA may also lodge a complaint with the data protection authority of their place of residence (Art. 77 GDPR).

16. Changes

We update this privacy policy whenever our data processing or the legal situation changes – for example when the newsletter or marketing services are introduced. The version published on this page applies.
